Significant Legal Proceedings in Spain Over Textile Waste Imports

In an unprecedented legal case, two individuals and two companies are set to stand trial in Spain for the unauthorized importation of nearly 1,800 tons of textile waste and used clothing from Morocco. This significant operation occurred in the Campo de Gibraltar region, specifically through the port of Algeciras, without the necessary environmental and administrative permits, as reported by various Spanish media outlets.

The indictment from the Algeciras Public Prosecutor's Office reveals that the primary accused, who is the sole administrator of one of the involved companies, allegedly oversaw a total of 44 shipments between late 2022 and mid-2023, amounting to an astounding 911.8 tons. He is accused of conducting these operations with the assistance of a co-defendant, who was the deputy director of the company at the time.

The prosecution indicates that the main accused utilized a second company, also under his leadership, to orchestrate an additional 41 shipments totaling 889.6 tons. The legal case encompasses 85 shipments, which collectively introduce 1,801.4 tons of clothing and textile scraps into Spain, where they were stored without the required authorization.

Investigators found that these materials were improperly stored in two industrial buildings located in San Roque, failing to meet legal standards. Moreover, the two companies involved were not registered in the Andalusian waste information system and lacked the necessary permits to operate. The public prosecutor contends that these imports also contravened European regulations governing cross-border waste transfers.

The prosecution is seeking a sentence of one and a half years in prison for each of the two accused individuals, alongside a prohibition from engaging in any waste management activities for the same duration. Financial penalties are also being requested against the two companies, coupled with a two-year restriction on their ability to operate within this sector. This investigation was initiated following the discovery of substantial quantities of textile waste in an unauthorized warehouse in San Roque, prompting the case to be referred to the criminal courts in Algeciras.
