Court Decision Supports Animal Rights in Morocco
In a landmark ruling, the Court of First Instance in Essaouira has mandated a defendant to pay a compensation of 3000 dirhams to the owner of a donkey that was deliberately attacked. This decision follows a severe incident where the donkey suffered significant injuries from a hatchet attack, which was justified by the assailant as a response to the animal entering his property. The events unfolded in March when the donkey, escaping a pack of dogs, wandered into the defendant's land, leading to the assault that left the animal with serious wounds.
The owner reported that the attack resulted in grave physical harm to the animal, particularly affecting its hind leg, and caused substantial emotional and financial distress to him. A veterinary report confirmed the existence of two lacerations on the donkey’s hindquarters and back, indicative of a sharp instrument's impact. Further clinical examinations conducted on March 12, 2026, revealed alarming vital signs, including an elevated heart rate of 76 beats per minute, indicating the animal was in considerable pain and required intensive treatment.
Advocacy for Animal Welfare
Prominent animal rights advocate and president of the "Rahim Association for Animal Welfare and Environmental Protection," Zainab Takan, who supported the plaintiff throughout the legal proceedings, described the incident as a brutal act of violence that occurred during the month of Ramadan. She emphasized the significance of the ruling, which not only acknowledges the crime but also reinforces the legal framework protecting vulnerable animals in Morocco. Takan noted that a witness from the local community bravely testified about the event, despite the social sensitivities in rural areas, which often deter individuals from coming forward.
The association continues to pursue this case through the appeals process to uphold the principle that animal cruelty is a punishable offense under Moroccan law. Takan reiterated that this case is not an isolated incident but rather a critical step towards preventing violent and inhumane behaviors against animals. She highlighted the ultimate goal of raising awareness that those who harm defenseless creatures may also pose a threat to human beings, and thus, the association is committed to advocating for legal protections for animals and ensuring that offenders face appropriate penalties.
