Madrid Court Rejects Visa Application Citing Unreliable Intentions

The Superior Court of Justice in Madrid has dismissed an appeal filed by a 74-year-old Moroccan woman against the decision made by the Spanish consulate in Tétouan, Morocco, which rejected her application for a short-stay visa submitted on February 6, 2025. The woman sought the visa to revisit Ceuta, the city where she spent her childhood while her father served in the military. However, the court found that the information she provided was "not reliable," and there were doubts regarding the conditions of her intended stay.

The appellant, a national and resident of Morocco, contested the administrative action denying her application for a short-stay visa (Type C), which she intended to use for tourism, specifically requesting multiple entries. The court expressed skepticism about her intention to leave the territory before the visa's expiration. The appeal argued that the visa's purpose was to allow her to reminisce about her childhood in Ceuta, asserting that she met all the requisite conditions for obtaining such authorization.

Additionally, the woman's son had pledged to cover all travel and visitation expenses following their crossing at Tarajal. In its ruling, the court upheld the denial of the application, emphasizing the necessity of adhering to regulations aimed at preventing misuse of short-stay visas for purposes such as immigration or economic gain, or to disguise family reunification efforts.

The court noted, "The challenged action articulates a reason for denying the applications that coincides with one of the scenarios outlined in state and community regulations, which allows for the response to this request to be framed in these terms, as was previously indicated." It further elaborated that the application indicated the requester was a 74-year-old widow without employment, intending to enter the Schengen area on March 1, 2025, and exit on March 6, 2025, while requesting multiple entries.

According to the court's assessment, the provided documentation revealed critical information that substantiated the legal grounds for denying the visa based on the unreliability of the applicant's stated purpose and conditions for the visit. Given that this visa was for a short duration with a specific aim, it inherently had a defined beginning and end, thus making the request for multiple entries inappropriate and indicating uncertainty regarding the true intent and conditions of the application.

This conclusion was further reinforced by evidence indicating that the appellant had booked a hotel in Torrejón de Ardoz and roundtrip flights to Madrid along with her son and another individual, despite her claim that the sole purpose of the visit was to return to Ceuta, where she spent her youth due to her father's involvement in the Spanish army.
