Prosecutor's Office Decision on Complaint Against Local Authority
On Friday, the public prosecutor at the Fes Court of Appeal made a significant decision regarding a complaint filed by a citizen against the local official known as the "Bacha" of Saiss. This decision follows an investigation initiated by the public prosecutor's office, which deals with matters concerning police officers and those with judicial privileges. The investigation has concluded that there was a lack of criminal evidence to support the allegations made in the complaint.
According to sources familiar with the situation, the investigation began on June 10 of the previous year. The prosecutor's office ultimately decided to archive the portion of the complaint related to alleged "professional misconduct," citing the absence of any criminal element. However, another part of the complaint has been forwarded to the public prosecutor at the Fes District Court for further consideration.
The initial complaint came from a resident of Ain Chkaf Road, who accused the local authority of several professional misconducts typically associated with individuals holding judicial privileges. Under Article 30 of the Criminal Procedure Code, the public prosecutor is required to forward any allegations of misconduct by police officers to the appropriate court for review.
Furthermore, Article 31 of the same code dictates that the court must order an investigation and hear the statements of the police officer involved. According to Article 32, the court can impose various penalties on the officer, which may include reprimands or temporary suspension from their duties for up to one year. The court also has the authority to dismiss the officer from their police duties entirely.
In light of the absence of any criminal evidence in this case, the public prosecutor has decided to archive the complaint, although it remains open for re-examination should new evidence come to light that may assist in the investigation.
